Terms and Conditions of Sale
Ordering and Purchasing of New Equipment

Aestec Australia Pty Ltd  (Aestec Australia) distributes:

(a) Aesthetic equipment and associated consumables.

(b) parts and disposable accessories (the “Products”) for use in medical, cosmetic and beauty salons;  from the Manufacturers ( the “Suppliers”).


The Purchaser acknowledges that, before paying the deposit for the Product, they have conducted due diligence and if necessary, sought further information/material from Aestec Australia as to the  fitness and suitability of the equipment for use. 


On receipt of the deposit, Aestec Australia will commence coordinating with the Supplier, to fulfill the Purchaser’s order.  Aestec Australia will not be responsible to the Purchaser for any delay associated with the delivery of the Products.


Aestec Australia Pty Ltd does not accept responsibility for the workmanship of the Supplier.


The Purchaser acknowledges, should the Product need assembling, Aestec Australia or their nominated technician will unpack, assemble, test and commission the equipment prior to use.


Aestec Australia Pty Ltd offers device familiarisation only and does not offer theoretical training. Aestec Australia will pay and provide contact details for no more than 4 staff, to the nominated trainer/training academy. All arrangements for day and time, are between the trainer and the Purchaser. For extra staff, training or training of new users and operators will be at the Purchaser’s expense.


To be deemed “properly trained user(s) and operator (s)”, the nominated trainer and or training academy will provide certification, in writing to Aestec Australia Pty Ltd. The Purchaser and staff must have the necessary academic, professional and trade qualifications as required to properly understand the manufacturer’s requirements needed to safely use and operate the equipment. It is the purchaser’s responsibility to ensure each user and operator nominated by the purchaser is properly qualified.

It is the Purchaser’s obligation to ensure that the device is maintained and used in accordance with the manufacturers user manual.

It is  the Purchaser obligation as apart of the term of purchase, that all users and operators are properly qualified and trained in the use of the Products.

It is the Purchaser obligation to use and operate the equipment in accordance with their State or Territory Health requirements, whichever is the more onerous.  

The users and operators, will exercise a standard of care in treatment of patients with full knowledge that any failure to comply may result in damage and or harm.  


The Purchaser will undertake and maintain a strict maintenance and service program in regard to the Products.


If the Purchaser does not maintain the Product in accordance with operating manual, the Purchaser agrees to indemnify Aestec Australia Pty Ltd from any damage or loss caused by the Products being used in any way other than in accordance with the  operating manual


The Purchaser must ensure the site has an electricity surge protection device to prevent damage to products supplied.


The Purchaser must not mislead the public to the extent on the treatment and or services provided


Aestec Australia is only the Supplier’s distributor, supplying to the purchaser only the Products listed on the invoice and not other equipment, parts accessories or services.


As permitted by the Australian Consumer Law and relevant State legislation, the only obligation of Aestec Australia is to provide the Products as identified in the invoice.


Aestec Australia Pty Ltd using its discretion, will repair the products; repair or replace any part of a product which is found to be defective during the warranty period of 12 months from the date of delivery of the Product.


If the product is a product not ordinarily acquired for personal, domestic or household use or consumption, pursuant to s 64A of the Australian Consumer Law and similar provisions of relevant state legislation then Australian Aesthetic Devices limits its liability to payment of an amount equal to the lowest of:

(1) the cost of replacing the goods or supplying equivalent goods;

(2) the cost of repair of the goods;

(3) the cost of having the goods repaired or replaced.


The purchase price for the Products together with any applicable GST and any other taxes, is payable in full to Aestec Australia Pty Ltd prior to delivery of the Product. Until payment is received in full, the purchaser acknowledges and agrees that no title or right to ownership in the Products passes to the purchaser. This right permits Aestec Australia Pty Ltd to register its interest under the Personal Property Securities Act 2009 (Cth) and the Purchaser acknowledges and consent to such registration.


In such circumstance,  that full payment is not received by Aestec Australia Pty Ltd  by the agreed date, Aestec Australia Pty Ltd will repossess the Products. Should the customer  default on the scheduled payment, Aestec Australia Pty Ltd is authorised to charge interest on the balance outstanding at 2% above the current rate prescribed under the Penalty Interest Rate in Victoria


The agreement for the supply of the goods is governed by the Law of the Commonwealth of Australia and interpreted in accordance with the State of Victoria.
